Legal And Usage Information

1 – General provisions

These Terms of Service govern the access and use of the website www.photocoded.com (hereinafter the “Site”) and constitute a binding agreement between the user (hereinafter “Customer”) of the services offered by the Site and the Site itself. Access and use of the Site are expressly subject to full acceptance and compliance with these Terms of Service. Note that any violation of these Terms of Use may result in the closure of the account.
Photocoded reserves the right to change these Terms of Service from time to time. Please refer to this web page periodically for any changes. By continuing to access or use the Site after such changes, the user agrees to be bound by the new Terms of Service.

2 – Services Offered

The services offered by Photocoded consist of a series of products, programs, widgets, services and websites made available by Photocoded that can be used for uploading, storing, downloading, sharing and transmitting text and image files. ( “Services” ).
Photocoded undertakes to provide, after receiving payment and images, photo editing services according to the photos and instructions presented by registered customers and within the established times. Photocoded also reserves the right to refuse the processing of a photograph for reasons that can be input to the Client’s failings (see point 4 – Client Obligations), or because it deems, at its sole discretion, impossible to work according to the Client’s expectations. . In this case, the option to replace the photograph or receive a refund will be given.

3 – Provision of Services

After receiving payment and images, if the photograph is successfully accepted Photocoded undertakes to work according to the instructions received from the customer for to contact him for real-time verificationand and to deliver the work done as quickly as possible, i.e. within the indicative limits of processing time for each service or alternatively. within the time limits indicated in the check-out or on a specific page of the Site. The working hours of a working day are understood to be from 10:00 to 19:00: for any order received outside these hours or within days of Saturday or Sunday or public holiday, the delivery deadline starts from 10:00 on the following Monday or from the first working day.
In the event that technical failures or organizational unforeseen events of any kind, including temporary ones, or exceptionally long processing times make it impossible to perform the services requested within the deadline set by the payment confirmation, Photocoded will inform the Customer well in advance (and will provide, according to the case-by-case agreement reached, for the execution of the requested service or for the full reimbursement of the sums paid for the payment of the same. Nothing can be requested from Photocoded for any delivery delays.
During the real-time verification, our operators will have to verify any information entered by the customer via direct access or private message, otherwise it will be impossible to approve the information.
For model-type photos in which a verification of appearance as well as identity is also required, each part displayed in the photo must be viewed live. Furthermore, the judgment of our operator cannot be influenced or contested in any way.
After verification, the encoded photo will be visible on the site and traceable through the search, and several copies with the encoded photo will be sent to the customer by email to be used where it deems appropriate.
Any artistic nude photographs will be published on the coded page with the appropriate censorship.

4 – Obligations of the Customer

The Customer, when accessing the services offered by the Site, assumes full and exclusive responsibility for the content and use of the images sent. Photocoded is not responsible for improper use of the images made by the Customer or by third parties after the purchase of the services. You agree not to post, insert or transmit any of the following materials or to obtain such materials using the Site:

  • Threatening, defamatory, offensive or inappropriate content or any material that may give rise to any civil or criminal liability under applicable law.
  • Any material that may violate the rights of privacy, publicity, copyright or other intellectual property rights without the authorization of the owner of these rights and the persons (or parents or legal guardians, if any), who are indicated in the material, if applicable.
  • Any material sent from an anonymous or false address.
  • Any material that promotes fanaticism, racism, hatred or violence towards any individual or group.
  • Any material that contains viruses or other code, files or programs created to interrupt, destroy or limit the functionality of any software or hardware or telecommunications equipment.

The Customer declares to release Photocoded, as well as the subjects linked or connected to it (such as, by way of example, managers, employees, representatives, etc.), from any compensation obligation towards third parties, including legal costs, which may derive from the images sent. and processed as well as by their content, by the services offered or by their use, as well as by the violation by the Customer of this Agreement.

5 – Rules for reviews

In order to write a review you must have purchased (and used) one of our services. It is not possible to post more than one review on the same order.
If your review violates the following guidelines, it will be rejected or removed:

  • Inappropriate content – We do not allow reviews that contain obscenities, vulgarity, phone numbers, email addresses, links to sites other than Photocoded.
  • Incitement to racism and offensive content – We do not allow reviews that express intolerance towards people belonging to groups identified by race, gender, religion, sexual preference or nationality. Customers can comment on the order and question the qualifications of the site or the graphic, but not in a threatening or insulting manner.
  • Promote illegal behavior – Reviews may not solicit or encourage illegal behavior, such as violence, drug use, underage alcohol use, and abuse of children or animals.

6 – Right of withdrawal

The execution of the personalized service requested by Photocoded has begun, pursuant to Legislative Decree 6 September 2005, n. 206 (Official Gazette no. 235, 8 October 2005 – SO no. 162), the exercise of the right of withdrawal by the Customer is always excluded.

7 – Guarantees

The images processed by Photocoded are and remain the property of the Customer who owns the rights to use them.
At the discretion of the customer, Photocoded provides different types of publication for the customer:

  • Publication of the photo on Photocoded Social Networks
  • Publication of the photo on the official Photocoded Portfolio

8 – Account

To access the Site, you must use a personal password. The Customer is responsible for maintaining the confidentiality of the information on your account and, consequently, will be fully responsible for all activities that take place on his account, including the activities of other people to whom he may decide to provide the account information.

9 – Refund rules

In case of refusal to process a photograph by Photocoded, the Customer may be offered a refund for the cost of the single photograph in place of a new one. If you are dissatisfied with our rating (for models type), your refund will NOT be issued.

10 – Photo replacement

It is not possible to replace a photo after the Service has been provided (verification and encoding). If you send a wrong photo you can communicate it during the real-time verification and replace it together with our operator before verification.

11 – Edit photos information

After verifying a photo and obtaining a code, it will no longer be possible to modify the information entered independently. (this is to ensure the veracity of the information shown).
To make changes to the information, such as the replacement / addition of a social profile or a telephone number, it will be necessary to contact the assistance through the appropriate tools communicating the data to be changed and follow the instructions for verification. This operation may require an additional cost.
Alternatively, the customer can delete the photo from photocoded at any time directly from their profile

12 – Image archive

We do not provide photo storage service and we do not keep photos on our server for more than 10 days after processing and after their deletion. Once the encoded photo has been sent to the Customer and replaced on the encoded page, the original photos will be removed from our server starting from the tenth day.

13 – Foro competente e legge applicabile

Ai sensi dell’art. 63 del D. Lgs. 6 settembre 2005, n. 206, per le controversie civili inerenti all’applicazione del presente contratto si riconosce la competenza territoriale del Tribunale nella cui circoscrizione il Cliente ha la propria residenza o il proprio domicilio, purché situati nel territorio dello Stato.
Per ogni altra controversia che dovesse eventualmente sorgere, ambedue le parti accettano la competenza esclusiva del Foro di Roma.
